However, a defective manufacturing claim could stem from a defect picked up during transportation or even when the product is in the hands of the retailer.

A defective marketing campaign relates to the packaging or instructions of a product. Manufacturers are not liable for injuries if the consumer fails to use the product as directed. However, if the instructions are unclear or fail to identify a major hazard, the liability could fall on the manufacturer.
