Types of Product Liability Claims

While there is no way to fit every product liability claim neatly into categories, most of them have certain elements in common. There are three general categories that many claims fall into. They include:

A defective design claim can be traced back to the drawing board, even before a single model is ever built. A manufacturing defect can occur at any point in the process after the design but before the product reaches the consumer. In many cases, these defects occur due to human error at the factory. However, a defective manufacturing claim could stem from a defect picked up during transportation or even when the product is in the hands of the retailer.

A defective marketing campaign relates to the packaging or instructions of a product. Manufacturers are not liable for injuries if the consumer fails to use the product as directed. However, if the instructions are unclear or fail to identify a major hazard, the liability could fall on the manufacturer.
