Burnaby Motorcycle Accident Lawyers

Motorcycle riders are often portrayed in the media as reckless thrillseekers who were “born-to-be-wild.” Unfortunately, this common stereotype often makes it difficult for people who were injured in motorcycle accidents to get the care and compensation they truly deserve.

In the province of British Columbia, ICBC is the sole provider of basic auto insurance. It is a Crown corporation, owned by the provincial government. After being injured in a collision, accident victims are required to complete and submit an ICBC claim to be assessed by the insurer. The insurance company’s assessment of the injured party’s claim will determine the amount of accident benefits to which they should be entitled. Unfortunately, largely because of unfair prejudice and bias against motorcyclists, the ICBC accident benefits allocated to injured motorcycle accident survivors are often too low to cover their total injury-related losses.

Now, because of sweeping changes to ICBC’s policies, it can be even more difficult for injured motorcycle riders to recover fair compensation for their injury-related costs. On May 1, 2021, ICBC implemented its new “enhanced care” model of insurance coverage. This new, no-fault system makes it nearly impossible for injured victims of motor vehicle accidents to sue the driver responsible for causing their collision. Therefore, even if another driver’s negligence on the road caused an accident in which a motorcyclist was injured after May 1, 2021, they have limited options for pursuing compensation through legal means.

In addition to taking away injured accident victims’ right to sue at-fault drivers, ICBC has made it harder to appeal unfair settlement decisions. If ICBC provides an injured motorcycle accident survivor with an insufficient amount of accident benefits (or denies their claim altogether), it can be very difficult for them to contest their wrongful determination. Many injured accident survivors feel abandoned by the Crown insurance provider because of these drastic new measures, and injured motorcyclists are advocating against ICBC’s no-fault policy

Motorcycle riders appreciate the risks associated with their preferred mode of travel. As such, they understand the importance of vigilance and caution on the road. Many motorcycle accidents in Burnaby are, indeed, the result of another motor vehicle operator’s negligence.

If you were hurt in a Burnaby motorcycle accident before May 1, 2021, you might still be entitled to pursue a civil claim against the driver whose negligence resulted in your collision. By working with our motorcycle accident lawyers serving Burnaby, you might be able to recover damages including:
