However, by implementing this new “enhanced care model,” ICBC has unilaterally taken rights away from injured accident victims. Injured cyclists are no longer able to sue the at-fault driver whose negligence caused their crash. On top of that, if a bicycle accident victim’s ICBC claim is denied or the settlement they are awarded is insufficient to cover their total injury-related losses, they will have limited options to appeal the insurance company’s determination.
