Burnaby Wrongful Death Lawyer

Since 1959, Preszler Injury Lawyers have been vocal advocates in wrongful death lawsuits. The emotional pain following an untimely death is unlike anything else, which is why we focus on representing our wrongful death clients with compassion and understanding.

Any untimely death has the potential to result in a viable wrongful death claim. These claims could involve motor vehicle collisions, medical malpractice, or even violent crime. An experienced Burnaby wrongful death lawyer from our firm will carefully review the circumstances surrounding your case to determine if it is strong enough for a claim to be filed.

If your family has suffered a wrongful death, you deserve a personal injury law firm that will vigorously defend your legal rights while respecting the gravity of your loss. To learn more, contact Preszler Injury Lawyers today.

The Family Compensation Act

In British Columbia, wrongful death claims are governed by the Family Compensation Act. This act was first enacted in 1846 and remains the primary way in which the courts compensate families for the loss of their primary wage earner. Claims under the Act are complex and are best handled by a caring wrongful death law firm.

Every province approaches family compensation differently. While many provinces have amended their version of the Family Compensation Act over the years, British Columbia’s version still maintains some limitations on damages that set it apart. For example, a Burnaby wrongful death claim cannot seek compensation for the loss of companionship a surviving spouse experiences.

Time limit to file a claim

As with most lawsuits, there is a strict deadline for the filing of a Burnaby wrongful death case. According to the British Columbia Limitations Act, a wrongful death lawyer must file suit within two years from the date the death occurred. These deadlines are strictly enforced. By failing to comply with this requirement, you could lose your ability to pursue a wrongful death claim despite having an otherwise strong case. At Preszler Injury Lawyers, we work diligently to ensure we meet every legal deadline.

How Preszler Injury Lawyers can help

A wrongful death lawsuit cannot turn back the clock or bring your loved one back. However, many unexpected deaths leave a financial hole that families are unprepared to fill.
