In assessing liability, the first step is establishing ownership of the animal. Unfortunately, if a stray bites someone and the owner is never found, it is impossible to file a claim. Once the dogโs ownership is established, however, you can file a claim under the doctrine of Scienterโif the dog has previously shown aggression, and the owner knows it. However, under current law, each dog can get away with โone free biteโ if the animal has never posed a threat.
If the dog bit you while you were on the ownerโs property, you might file a claim under the Occupierโs Liability Act. Under the OLA, pet owners are responsible for their animals on their property. A third option involves a negligence claim, as the owner should have known the dog was a danger and did not take preventive measures.
