The first legal theory is known as scienter. Under this, a dog owner who knew or should have known that their dog was dangerous– is liable for any injuries they cause. To prove a claim, you must establish:

  • The defendant owns the dog responsible for your injuries
  • The dog is inclined to be violent, and
  • The owner knew or should have known about those inclinations

Typically, a plaintiff can prove at trial that a dog was violent. They can do this by providing evidence that the animal had previously attacked someone else. If you meet these three elements, there is little defence a dog owner could offer.

In addition to scienter, you could also pursue a negligence claim. The burden for proving this is higher, but it does not require evidence that the owner knew their animal was dangerous. However, you would need to prove that they were careless in allowing it to injure you.
