Important Notice: Our firm is able to assist with bicycle accident claims that did not involve a motor vehicle. For bicycle accidents involving a motor vehicle, we are only able to assist if the incident occurred before May 1st, 2021.
Despite all the bike lanes and idyllic places to visit, the Vancouver Metro (including Delta) ranks as one of the “worst places in the world for bike-related accidents.” There are approximately 1,456 accidents per 100,000 cyclists in our backyard. The only other Canadian city comparable to our number of injuries and fatalities is Montreal. We may pale in comparison to Boston’s 3,459 bike accidents for every 100,000 cyclists, but it is hardly anything to brag about. As a city, we can and must do better to stop these preventable accidents from occurring.
Preszler Injury Lawyers Advocates for Your Rights & Helps You Seek Justice
The Delta bicycle accident lawyers at Preszler Injury Lawyers understand the gravity of the situation when cars and bicycles collide. We are at the forefront of the movement to hold motorists accountable for their actions – whether it’s speeding, tailgating, failing to yield right-of-way, failing to signal, running a red light, rolling through a stop sign, or opening a door into a bike lane without looking first.
Even if you were distracted while biking, illegally riding on a sidewalk, or otherwise partially at fault for what happened, you might still be eligible to collect compensation from the driver for your medical bills. The total amount recoverable will be reduced by the amount of fault ascribed to you. So, for instance, if you are to receive $350,000, but you are deemed 25% “at-fault,” you will only be able to collect $262,500 of the total.

Who Will Pay for Your Medical Bills?
Many cyclists do not realize this, but it is customary to file a claim with ICBC when a collision involves a motorist. Even if you do not own a motor vehicle or insurance, the fact that an insured driver was involved makes it an ICBC case. Within two years of the accident, you can file for Part 7 “No-Fault” insurance benefits.
ICBC must pay for all reasonable expenses incurred, including medical, surgical, dental, chiropractic, and hospital treatments. They will typically cover the cost of your ambulance ride, occupational/speech/physical therapies, home nursing services, prosthesis, or orthosis. If you are completely unable to work as a result of your injuries, ICBC will cover Temporary Total Disability benefits up to $740/week. If you are so injured you cannot maintain your household, ICBC will pay up to $280/week for homemaking assistance. These totals increased in 2019 for the first time in 25 years. They also pay up to $37,500 in funeral expenses and survivors’ benefits in the event of a fatal crash.
While this may sound like a simple and straightforward process, it is not. It could be an easy case if you were hurt, took a few weeks to recover, and you’re better now. However, often with more serious injuries and long-term disabilities, a personal injury law firm is essential in advocating for maximum benefits.

Does ICBC Insurance Cover Bicycle Accidents?
Environmental awareness and a culture of increased physical fitness have led many people to become avid cyclists. But accidents happen, even to those on bicycles….
bicycle accident FAQs
Here are some commonly asked questions for bicycle accident claims
What should I do after a bicycle accident in BC?
After a bicycle accident, your number one priority should be seeking medical attention. Document the scene, collect witness information, and report the incident to ICBC. Speaking with a lawyer early on can help you protect your right to compensation.
Can I still claim compensation if I wasn’t wearing a helmet?
In BC, helmets are legally required for all bicycle riders to wear. Not wearing a helmet could reduce the amount of compensation you receive. However, it does not automatically bar you from filing a claim. Your lawyer can help you examine whether another party’s negligence caused the accident and help you seek compensation.
What if I was a cyclist at the time of my accident?
Cyclists hit by motor vehicles are able to make ICBC claims.
ICBC should pay for the treatment you reasonably need to recover from your injuries. ICBC commonly pays for physiotherapy, medication, massage therapy and chiropractic care to help treat your injuries. If you need to attend the gym, then ICBC should pay for your gym pass. If you have driving anxiety, depression, anxiety or post-traumatic stress disorder, then ICBC should pay for your counseling.
You are also likely entitled to make a claim against the driver who caused your accident. You may recover damages for pain and suffering, out of pocket expenses, treatment expenses, loss of income, housekeeping expenses and more.
